1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and ProGradeAZ Construction LLC, a limited liability company registered in Arizona ("ProGradeAZ," "we," "us," or "our").

By accessing our website at progradeaz.com, submitting a service request, booking an appointment, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

2. Eligibility & Age Restriction

Age Requirement (18+)

You must be at least 18 years of age to use our website, submit service requests, book appointments, or use any of our services. By accessing or using our services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding contract.

If you are under the age of 18, you may not use our website or services without the involvement and consent of a parent or legal guardian who is at least 18 years of age. Any use of our services by individuals under 18 must be supervised by a parent or guardian.

SMS/Text Messaging Age Restriction: To receive SMS/text messages from ProGradeAZ, you must be at least 18 years of age or have parental/guardian consent. By providing your mobile phone number and consenting to receive text messages, you confirm that you meet this age requirement.

We reserve the right to terminate any account or refuse service to any user if we have reason to believe they do not meet the age requirement.

3. Services Description

ProGradeAZ provides professional window and door installation services for residential properties in Arizona. Our services include but are not limited to:

  • Window installation, replacement, and repair
  • Door installation, replacement, and repair
  • Energy-efficient upgrades and consultations
  • Custom window and door solutions
  • Free in-home estimates and measurements

All services are subject to availability and scheduling. We reserve the right to refuse service to any location outside our service area or for projects that do not meet our safety or feasibility standards.

4. User Accounts and Information

When you submit a service request or book an appointment through our website, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your access if any information provided is inaccurate, outdated, or incomplete.

5. Quotes and Pricing

All quotes provided by ProGradeAZ are estimates based on the information provided during the consultation. Final pricing may vary based on:

  • Actual measurements taken during the in-home assessment
  • Product selection and customization options
  • Site conditions and installation complexity
  • Applicable taxes and permit fees

Promotional offers and discounts (including the "$500 off installation" offer) are subject to specific terms and expiration dates. Offers cannot be combined unless explicitly stated.

6. Payment Terms

Payment terms are as follows:

  • A deposit may be required to secure materials and schedule installation
  • Final payment is due upon satisfactory completion of the project
  • We accept cash, checks, and major credit cards
  • Financing options may be available through approved third-party lenders

All payments are non-refundable once materials have been ordered or work has commenced, except as required by law or as specified in your service agreement.

7. Cancellations and Rescheduling

We understand that plans change. Our cancellation and rescheduling policy is as follows:

  • Cancellations made more than 48 hours before the scheduled appointment will not incur any fees
  • Cancellations made within 48 hours may be subject to a rescheduling fee
  • No-shows without prior notice may result in forfeiture of any deposit

8. Warranty and Guarantees

ProGradeAZ stands behind the quality of our work:

  • Lifetime Workmanship Warranty: We guarantee our installation work for the lifetime of the product, covering defects in installation
  • Manufacturer Warranties: All products come with manufacturer warranties as specified by the product manufacturer
  • Satisfaction Guarantee: If you are not satisfied with our work, we will make reasonable efforts to address your concerns

Warranty claims must be submitted in writing and are subject to inspection. Warranties do not cover damage caused by misuse, neglect, natural disasters, or unauthorized modifications.

9. SMS/Text Message Terms

Text Messaging Service Terms

Consent Required: By providing your mobile phone number and checking the consent boxes on our forms, you expressly consent to receive SMS/text messages from ProGradeAZ.

Message Frequency: Message frequency varies based on your service needs. You may receive:

  • Appointment confirmations and reminders (typically 1-3 per appointment)
  • Project updates during active installations (as needed)
  • Marketing messages (up to 4 messages per month, only with marketing consent)

Carrier Charges: Message and data rates may apply according to your wireless carrier plan. ProGradeAZ does not charge for sending text messages.

Opt-Out Instructions: To stop receiving text messages, reply STOP to any message from us. You will receive a confirmation message, and no further messages will be sent unless you opt back in.

Supported Carriers: Our SMS service is supported by major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Delivery is not guaranteed and may be affected by carrier limitations.

Liability: ProGradeAZ is not liable for delayed or undelivered messages caused by carrier issues, technical problems, or circumstances beyond our reasonable control.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of ProGradeAZ or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law, ProGradeAZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
